Who needs to take action?

The creation of an account in the Fuel Platform must be carried out only by entities performing reporting and information obligations to the ERO President, as specified in Articles 4ba (1), 43d (1) and 43e (1) of the Act of April 10, 1997. - Energy Law (Journal of Laws of 2022, item 1385, as amended).

IMPORTANT!!! ENTITIES THAT:
A) BUY AND SELL ONLY FILLED LPG CYLINDERS,
B) SELL FUEL ONLY THROUGH FUEL CARDS
ARE NOT REQUIRED TO CREATE AN ACCOUNT IN THE FUEL PLATFORM

As of July 1, 2023, all reporting and information obligations mentioned above - performed by WPC, OPC, OPZ, MPC, PPC,WPC-licensed enterprises and entities entered in the Registers of Importing Entities will be carried out exclusively through theFuel Platform system.

The obligation to create an account in the Fuel Platform therefore also applies to companies submitting information to the ERO President about the liquid fuel infrastructure used in their operations. From 1 July 2023, this information will be able to be submitted only through the Fuel Platform. Therefore, it is important to create a user account in the Fuel Platform in advance.

IMPORTANT!!! USER ACCOUNT ON THE PLATFORM WILL BE CREATED BY RARS AFTER RECEIVING THE DOCUMENTS DESCRIBED BELOW:

A. Entrepreneurs who will independently perform activities in the Fuel Platform (sole proprietors, authorized partners or members of the board of directors) are not required to appoint a proxy.

They will be :

• in the case of economic activity registered in the CEiDG - the owner or partner in a civil partnership authorized to represent the entity single-handedly;
• In the case of entities registered in the National Court Register - a member of the board of directors / shareholder authorized to represent the entity on a one-person basis.

For such persons, it is necessary to COMPLETE AND SEND ORIGINALS (PAPER VERSION) of the FOLLOWING DOCUMENTS, available at www.rars.gov.pl - Fuel Platform:

1. a completed declaration (RARS template) - defining the scope of authorization to act within the scope of activities in the Fuel Platform; HERE WE MUST PROVIDE THE MAIL ADDRESS (as the basis for the operation of the account), TELEPHONE NUMBER, ADDRESS AND NAME OF THE COMPANY, MARK THE LEVEL OF AUTHORIZATION - URE_P3 AND SIGN IN OWNER'S HANDS

2. the RARS information clause (RARS template) - SIGN IN OWN HAND.

3. a current excerpt from CEiDG or KRS or other document confirming the legal form; PRINTED ON THE DAY OF SENDING THE LETTER.

B. Entrepreneurs who will perform activities in the Fuel Platform through a proxy will need to submit a paper version:

1. power of attorney (model RARS), signed in accordance with the rules of representation of the entrepreneur
2. current excerpt from CEiDG or KRS or other document confirming legal form; PRINTED ON THE DAY OF SENDING THE LETTER
3. completed statement (RARS template) - defining the scope of authorization to act within the scope of activities in the Fuel Platform; HERE WE MUST FOLLOW THE MAIL ADDRESS OF THE FACILITY (as the basis for the operation of the account), TELEPHONE NUMBER, ADDRESS AND NAME OF THE COMPANY, MARK THE LEVEL OF AUTHORIZATION - URE_P3 AND SIGN IN OWNER'S HAND;
4. RARS information clause (RARS template) - SIGN IN OWN HAND.
5. submission of proof of payment of stamp duty on the power of attorney (PLN 17) to the account:
   Taxpayer Service Center, 57 Obozowa St., 01-161 Warsaw, account no. 21 1030 1508 0000 0005 5000 0070 

If more than one power of attorney is granted, such as for several employees, the above documents, including the stamp duty, should be submitted in the amount corresponding to the number of authorized representatives.

Scope of the Power of Attorney

This information is directed primarily to entities holding liquid fuels trading licenses (OPCs), operating with technical infrastructure, and entities contracting the service of transportation to the end user. Therefore, in the vast majority of such cases in the scope of the power of attorney as the scope of authority will need to be indicated: Level of authority: ERO_P3.

In each case, however, the scope of the activity should be reviewed in terms of also other reporting obligations under the ACT (in terms of RARS' authority). 

IMPORTANT!!! In the document: Scope of authorization it is necessary to provide the full and accurate name of the entrepreneur with Tax Identification Number, name of the user / proxy, telephone number of the user / proxy and email address of the user / proxy.

Additional information. Summary.

After receiving and verifying the correctness of the above documents, RARS will create a user account and provide authorized persons with user accounts and logins for its operation. This may take up to several business days.

Creating an account will be a prerequisite for using the Fuel Platform.

The indicated documents must be submitted only by letter, in originals, to the address of RARS. It is not possible to submit the above documents through electronic communication channels, including the use of electronic / qualified signatures.

Information and reports previously submitted to the ERO remain valid, there is no need to resubmit them.

PERSONS ENTERING DATA INTO THE FUEL PLATFORM MUST HAVE:  

• ‍ELECTRONIC SIGNATURE- SAPPHIRE (SAPPHIRE SDK EXTENSION AND SAPPHIRE HOST APPLICATIONS MUST BE ENABLED TO WORK WITH THE SYSTEM) OR
• ‍E-EVIDENCE OR‍.
